In February 2022, the Court of Protection was faced with the question of whether a kidney transplant was in the best interests of William Verden. The case highlighted the legal, ethical and clinical complexities of treating potential kidney transplant patients with impaired decision-making. Above all, it exposed the potential risk of discrimination on the basis of disability when treatment decisions in relation to potential kidney recipients with impaired capacity are being made. In this paper, we draw on the Verden case (...) to (1) examine the role of the Court of Protection in cases relating to patients with impaired decision-making capacity who require a transplant, (2) to highlight the lack of empirical data on patients who have faced inequitable access to transplant and (3) highlight the shortcomings of the existing legal and regulatory framework in England and Wales guiding clinical decision making for patients in William’s position. We consequently argue that there is a clear need for action to ensure equitable access to transplant for those in William’s position. Furthermore, we suggest that there is a responsibility incumbent on policy makers and clinicians alike to develop a meaningful, and meaningfully operational, framework centred on preventing discrimination against potential organ recipients based on their decision-making capacity. The origin of the Samaritans re-examinedThe traditional approach to the study of the origins of the Samaritans as a group or a nation usually takes 2 Kings 17 to be a description of their origin. The aim of this article is to show that there is little or no evidence in 2 Kings 17 pointing in this direction. Several factors in history and in ancient literature make it almost impossible to come to any definite conclusion as to the origin of (...) the Samaritans as they are known to us in the New Testament. We have synthesized a 582,970-base pair Mycoplasma genitalium genome. This synthetic genome, named M. genitalium JCVI-1.0, contains all the genes of wild-type M. genitalium G37 except MG408, which was disrupted by an antibiotic marker to block pathogenicity and to allow for selection. To identify the genome as synthetic, we inserted "watermarks" at intergenic sites known to tolerate transposon insertions. Overlapping "cassettes" of 5 to 7 kilobases (kb), assembled from chemically synthesized oligonucleotides, were joined by in vitro recombination to produce intermediate (...) assemblies of approximately 24 kb, 72 kb ("1/8 genome"), and 144 kb ("1/4 genome"), which were all cloned as bacterial artificial chromosomes in Escherichia coli. Most of these intermediate clones were sequenced, and clones of all four 1/4 genomes with the correct sequence were identified. The complete synthetic genome was assembled by transformation-associated recombination cloning in the yeast Saccharomyces cerevisiae, then isolated and sequenced. A clone with the correct sequence was identified. The methods described here will be generally useful for constructing large DNA molecules from chemically synthesized pieces and also from combinations of natural and synthetic DNA segments. 10.1126/science.1151721. The purpose of this study was to ascertain South African Small, Medium and Micro Enterprise owners'/managers' perceptions regarding the importance of corporate social responsibility in this sector of the economy. Their views were gauged by means of a questionnaire based on Carroll's CSR hierarchy. Descriptive and inferential statistics, based on 262 questionnaires, show that SMME owners/managers viewed CSR as a very important business practice in South Africa. Given the critical role that SMMEs can play in addressing South Africa's socio-economic needs, (...) it is recommended that more SMME owners/managers be educated as to what CSR entails and how it can be implemented. This article provides ethical guidance on using race in health research as a variable or in defining the study population. To this end, a plain, non-exhaustive checklist is provided for researchers and research ethics committees, preceded by a brief introduction on the need for justification when using race as a variable or in defining a study population, the problem of exoticism, that distinctions pertain between race, ethnicity and ancestry, the problematic naming of races, and that race does not serve well (...) as a presumed biological construct in genetic research. A Life Decoded is an exhilarating document, to begin with, reading like a novel or even a science epic. In the author’s own words, it is “a tale of seemingly impossible quests and grand objectives”, of “great rivalries and bitter disputes”, of “battles of ideologies, morals and ethics” and of “clashes of egos” (p. 2), an adventure that swept the author “from peaks of incredible exhilaration as I marshaled a relatively small but dedicated army of scientists, computers and robots to (...) achieve what seemed almost impossible, and then plunged me into black pits of depression as I faced opposition from Nobel laureates and senior government officials, my colleagues, and even my wife” (p. 2). Moreover, besides being an autobiography proper, the book also contains a series of reflections on the genes present in the author’s own genome, one of the first individual genomes that was sequenced and made publicly available on the web – the “recipe” that made Craig Venter, as he himself describes it. In separate boxes dedicated to his sequenced genome, he especially focuses on genes that are associated with behavioural characteristics such as thrill-seeking behaviour, ADHD and the ability to cope with almost superhuman amounts of stress. Thus, in Venter’s case, autobiography and the genome are connected in more than one way with one another. (shrink)

We can contrast rationalising explanations of the form S φs because p with those of the form S φs because S believes that p. According the Common Kind View, the two sorts of explanation are the same. The Disjunctive View denies this. This paper sets out to elucidate the sense in which the Common Kind Theorist asserts, but the Disjunctivist denies, that the two explanations are the same. I suggest that, in the light of the distinction between kinds of explanation (...) and particular explanations, the relevant sameness thesis is ambiguous, thus giving us two distinct versions of the Common Kind View. I then argue that the only direct arguments for Disjunctivism available in the literature fail because they only succeed in undermining one version of the Common Kind View. I finish, however, by providing a fresh argument for the Disjunctive View which aims to undermine both versions of its competitor. (shrink)

It is now common to distinguish Metaphysical from Epistemological Disjunctivism. It is equally common to suggest that it is at least not obvious that the latter requires a commitment to the former: at the very least, a suitable bridge principle will need to be identified which takes one from the latter to the former. This paper identifies a plausible-looking bridge principle that takes one from the version of Epistemological Disjunctivism defended by John McDowell and Duncan Pritchard, which I label Reflective (...) Epistemological Disjunctivism, or (RED), to Metaphysical Disjunctivism. Moreover, it identifies a modification the proponent of (RED) could, and should, make to the Internalist component of their theory, and argues that the commitment to Metaphysical Disjunctivism remains, even if such a modification is made. The upshot is that the commitment to Metaphysical Disjunctivism on the part of (RED) is shown to be particularly robust. (shrink)

Here is a surprisingly neglected question in contemporary epistemology: what is it for an agent to believe that p in response to a normative reason for them to believe that p? On one style of answer, believing for the normative reason that q factors into believing that p in the light of the apparent reason that q, where one can be in that kind of state even if q is false, in conjunction with further independent conditions such as q’s being (...) a normative reason to believe that p. The primary objective of this paper is to demonstrate that that style of answer cannot be right, because we must conceive of believing for a normative reason as constitutively involving a kind of rationality-involving relation that can be instantiated at all only if there is a known fact on the scene, which the agent treats as a normative reason. A secondary objective, achieved along the way, is to demonstrate that in their Prime Time Errol Lord and Kurt Sylvan do not succeed in undermining the factoring picture in general, only a simple-minded version of it. Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...) and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. This book should be of interest to welfare economists, political scientists and decision-theorists. (shrink)

Advances in the understanding of genetics have led to the belief that it may become possible to use genetic engineering to manipulate the DNA of humans at the embryonic stage to produce certain desirable traits. Although this currently cannot be done on a large scale, many people nevertheless object in principle to such practices. Most often, they argue that genetic enhancements would harm the children who were engineered, cause societal harms, or that the risks of perfecting the procedures are too (...) high to proceed. However, many of these same people do not have serious objections to what is called ‘genetic planning’ procedures (such as the selection of sperm donors with desirable traits) that essentially have the same ends. The author calls the view that genetic engineering enhancements are impermissible while genetic planning enhancements are permissible the ‘popular view’, and argues that the typical reasons people give for the popular view fail to distinguish the two practices. This paper provides a principle that can salvage the popular view, which stresses that offspring from genetic engineering practices have grounds for complaint because they are identical to the pre-enhanced embryo, whereas offspring who are the result of genetic planning have no such grounds. It’s one thing to do the right thing. It’s another to be creditable for doing the right thing. Being creditable for doing the right thing requires that one does the right thing out of a morally laudable motive and that there is a non-accidental fit between those two elements. This paper argues that the two main views of morally creditable action – the Right Making Features View and the Rightness Itself View – fail to capture that non-accidentality constraint: the first (...) because it morally credits agents who make heavy-duty moral mistakes; the second because it fails to generalise and is too conservative – a point which this paper gives renewed defence. The paper then goes on to defend and develop an alternative according to which moral worth is mediated by the agent’s knowing how to respond to the reasons of the type which make acting in that way right. It’s argued that this view avoids the problems for the alternatives, and it’s shown that in order for the view to avoid collapsing into a problematic form of Reliabilism we’ll have to think of states of knowing how as essentially successful in character. This paper begins with a Davidsonian puzzle in the epistemology of perception and introduces two solutions to that puzzle: the Truth-Maker View (TMV) and the Content Model. The paper goes on to elaborate (TMV), elements of which can be found in the work of Kalderon (2011) and Brewer (2011). The central tenant of (TMV) is the claim that one's reason for one's perceptual belief should, in all cases, be identified with some item one perceives which makes the proposition believed true. (...) I defend an argument against (TMV) which appeals to (a) the claim that the reason for which one believes should always to be identified with the explanans of the rationalising explanation to which one's belief is subject and (b) the claim that the explanantia of rationalising explanations must be identified with truths. I finish by replying to two objections to the argument. (shrink)

In this article I try to refute the so-called "libertarian" theory of free will, and to examine how our conclusion ought to modify our common attitudes of praise and blame. In attacking the libertarian view, I shall try to show that it cannot be consistently stated. That is, my dscussion will be an "analytic-philosophic" one. I shall neglect what I think is in practice an equally powerful method of attack on the libertarian: a challenge to state his theory in such (...) a way that it will fit in the modern biology and psychology, which are becoming increasingly physicalistic.
